Earlier this year, Microsoft faced a sales ban in Germany for infringing a Motorola patent. The same case that appeared in Germany is going to cause some problems for Microsoft in the U.S.
A judge believes that Microsoft did infringe on a Motorola patent and that the Xbox should be banned in the U.S.They also believe that Microsoft should post a 7% bond for any unsold Xbox's.
This is a problem for Microsoft and they are obviously appealing this ban but if it went through in Germany, it gives some precedent to why it should be banned in the U.S.
If the Judge's claim is backed up by the ITC, this case will end up on President Obama's desk. His administration will have final say on what the fate of the Xbox will have.
Personally studying business law, I feel that the Xbox will end up being banned. This is not as big as people might first believe. The market is already saturated for Microsoft and no one is going to be buying too many Xbox consoles. The next-gen consoles will takeover soon and that is where the focus will shift. If this case were brought up earlier, it would be a huge financial loss for Microsoft but not so much now.
